PW Hosting LLC / Policies
Terms of Use
Effective date: September 11, 2026. These policies apply to PW Hosting LLC services offered through pwhosts.com, admin.pwhosts.com (the customer support portal), and the pwhosts.com support alias.
1. Acceptance of Terms
These Terms of Use are a binding agreement between you and PW Hosting LLC regarding your access to and use of PW Hosting LLC websites, including pwhosts.com and admin.pwhosts.com, hosting accounts, servers, storage, SFTP access, databases, email-related tools, support, and any related services.
By visiting the website, opening an account, using the services, renewing service, submitting a support request, or allowing anyone else to use your account, you accept these Terms of Use, the Privacy Policy, the Acceptable Use Policy, the Anti-Spam Policy, and any plan-specific terms shown at the time of purchase.
If you use the services for a business, organization, or another person, you represent that you have authority to bind that party to these terms. If you do not agree, do not use the website or services.
2. Services and Account Eligibility
PW Hosting LLC provides web hosting plans intended for lawful websites, databases, file transfer, domain-related hosting, and related online projects. Service features vary by plan, including disk space, transfer, SFTP logins, subdomains, and MySQL databases. Feature descriptions are not guarantees that every software package, traffic pattern, script, or use case will be supported.
You must provide accurate account, billing, domain, and support information. You are responsible for keeping your contact information current so that PW Hosting LLC can reach you about billing, security, abuse, service notices, renewals, and policy issues.
3. Account Security
You are responsible for all activity under your account, including activity by employees, contractors, users, customers, scripts, applications, compromised credentials, or third parties who gain access through your systems. You must protect passwords, SFTP credentials, database credentials, control-panel credentials, application logins, and email accounts.
You must promptly notify PW Hosting LLC at support@pwhosts.com if you suspect unauthorized access, compromise, malware, phishing, spam, data exposure, or other security issues.
You are responsible for maintaining secure website software, themes, plugins, libraries, scripts, file permissions, and configurations. PW Hosting LLC may suspend or restrict service when an account appears compromised or creates risk to the network, other customers, or the public.
4. Customer Content and Responsibility
You retain ownership of content you place on the service. You grant PW Hosting LLC the limited rights needed to host, store, transmit, cache, back up, display, secure, scan, troubleshoot, and otherwise operate the services for you. You are solely responsible for your websites, files, databases, applications, code, email content, customer data, logs, domain configuration, and all claims arising from them.
You represent that you have all rights and permissions needed for the content and data you host. You must provide your own privacy notices, cookie notices, terms, refund policies, security practices, and regulatory disclosures to your own visitors and customers when required by law.
5. Acceptable Use
You may not use the services for unlawful, harmful, abusive, deceptive, or disruptive purposes. Prohibited uses include malware, phishing, credential theft, botnets, unauthorized scanning, denial-of-service activity, spam, fraud, impersonation, harassment, threats, illegal content, child sexual abuse material, intellectual-property infringement, sale of illegal goods or services, privacy violations, or activity that damages PW Hosting LLC, other customers, networks, or third parties.
You may not attempt to bypass security controls, account limits, usage limits, billing systems, authentication systems, suspension controls, or network restrictions. You may not resell or assign service unless PW Hosting LLC gives written permission.
6. Resource Use and Fair Use
Hosting plans include defined storage, transfer, database, SFTP, and subdomain allocations. Shared or managed infrastructure may also have practical limits on CPU, memory, process count, database load, inode count, mail volume, file operations, connection volume, backup load, and other resources. PW Hosting LLC may throttle, suspend, move, require an upgrade, or terminate accounts that degrade service quality, create security risk, or exceed reasonable use for the selected plan.
Large allocations or high extra-site limits, when offered, are subject to fair use, technical limits, abuse controls, and lawful use. These limits do not waive operational, DNS, security, software, or abuse controls.
7. Billing, Payments, Renewals, and Taxes
Prices are listed in United States dollars unless otherwise stated. You agree to pay all charges for the plan, renewal period, add-ons, setup, overages, recovery work, domain services, third-party services, taxes, and other fees you request or incur. Annual or prepaid pricing, when offered, will be shown at purchase unless a separate written agreement states otherwise.
For customers migrated from ProHosting, PW Hosting LLC may initially honor legacy ProHosting pricing during transition periods at its discretion. This transitional pricing is temporary, is not guaranteed for any specific duration, and does not create a permanent right to legacy rates, plans, discounts, billing cadence, or package structure.
PW Hosting LLC reserves the right to change pricing, plan structure, included features, usage limits, billing cycles, and fees at any time by providing notice consistent with these Terms or applicable law. Continued use of the services after the effective date of updated pricing or plan terms constitutes acceptance of those changes.
You authorize PW Hosting LLC or its payment providers to charge your selected payment method for recurring fees and other authorized charges. You are responsible for payment failures, expired cards, chargebacks, bank fees, currency conversion costs, taxes, and inaccurate billing information. Service may be suspended or terminated for late, failed, disputed, or reversed payments.
8. Cancellations and Refunds
Cancellation requests must be sent to support@pwhosts.com and should include the account name, domain, plan, and requested cancellation date. You remain responsible for charges incurred before cancellation is confirmed.
If you prepay for a hosting term longer than one month and cancel within 30 days after the prepaid term begins, PW Hosting LLC may provide a prorated refund for the unused portion of the prepaid hosting service. After 30 days, unused prepaid hosting balances, account credits, and remaining time on prepaid hosting terms are non-refundable, including when you move to another host, stop using the service, or cancel for any other reason.
Unless PW Hosting LLC states otherwise in writing, fees for used service periods, setup work, domains, SSL certificates, dedicated resources, migration work, recovery work, add-ons, overages, support labor, payment processing costs, and third-party costs are non-refundable.
Prepaid hosting time, migrated prepaid service, account credits, promotional credits, migrated balances, and any other service credits are associated solely with the individual hosting account to which they were originally applied. They are not transferable, mergeable, or exchangeable between accounts, services, or customers unless PW Hosting LLC expressly agrees otherwise in writing. Closing or cancelling an account does not entitle the customer to transfer, consolidate, or recover unused prepaid service or credits.
Refunds, credits, or service extensions not described above, if provided, are discretionary unless required by law or by a written agreement signed by PW Hosting LLC.
9. Support
Support is available by email at support@pwhosts.com. Support requests should include your domain, plan, account identifier, relevant timestamps, error messages, screenshots when useful, and a clear description of the issue. PW Hosting LLC may provide best-effort assistance but does not guarantee support for every third-party application, script, plugin, theme, custom code, DNS provider, registrar, mail client, or external service.
PW Hosting LLC is committed to treating customers professionally and expects the same in return. Customers may not engage in abusive, threatening, harassing, discriminatory, or excessively offensive conduct toward staff through support tickets, email, telephone, chat, social media, or any other communication channel.
If a customer engages in such conduct, PW Hosting LLC may, at its discretion, issue a warning, restrict access to support channels, require communication through a single designated method, suspend service, or terminate service in accordance with these Terms. Nothing in this section obligates PW Hosting LLC to continue providing support to individuals who abuse or harass its staff.
Support is intended to assist with issues directly related to PW Hosting LLC services. Repetitive, excessive, frivolous, or abusive support requests that unreasonably consume staff resources may be limited or declined at PW Hosting LLC's discretion.
10. Backups and Data Loss
You are responsible for maintaining independent backups of all websites, databases, email, files, credentials, configuration, and business records. PW Hosting LLC may create backups for operational purposes, but backups are not guaranteed, may be incomplete, may not be retained, may be overwritten, and may not be available for restoration. You should not use the service as your only copy of important data.
PW Hosting LLC may generate and retain system, access, security, and operational logs for service administration, troubleshooting, abuse prevention, and legal compliance. Log retention periods are set by PW Hosting LLC in its sole discretion and may vary by log type, system needs, and legal requirements. Logs may be deleted, overwritten, or unavailable at any time, with or without notice.
Customers may request available logs by contacting support, and PW Hosting LLC may, but is not obligated to, provide logs in whole or in part, and may limit, redact, or deny log access for security, privacy, legal, operational, or third-party reasons.
To the fullest extent permitted by law, PW Hosting LLC is not liable for data loss, corruption, deletion, unauthorized access, failed restoration, or business interruption.
11. Uptime, Migration, and Service Changes
PW Hosting LLC works to provide reliable service, but you should expect some downtime. Hosting, DNS, email, control-panel, and migration activity may be interrupted by maintenance, upgrades, abuse mitigation, security incidents, hardware failure, software failure, network issues, DNS issues, third-party providers, force majeure events, customer configuration errors, or migration complexity. Short or longer interruptions can occur without notice. Downtime is not a breach of these terms and does not entitle you to a refund, credit, or damages unless a separate written service-level agreement signed by PW Hosting LLC says otherwise.
No uptime, performance, deliverability, search ranking, revenue, compatibility, migration outcome, or data recovery guarantee is made unless a separate written service-level agreement applies.
Migration may require customer action, including DNS changes, mail-client updates, application or integration updates, credential updates, registrar actions, testing, and post-cutover remediation. PW Hosting LLC will use commercially reasonable efforts to complete migration and resolve migration-related issues, but does not guarantee that migration will be successful, complete, uninterrupted, or free of defects for every account.
PW Hosting LLC may modify, replace, suspend, discontinue, or limit features, plans, software versions, server configurations, control panels, pricing, or services when necessary for security, reliability, legal compliance, vendor changes, migration constraints, or business operations.
12. Domains, DNS, Email, and Third-Party Services
When you register or transfer a domain through PW Hosting LLC, you are the beneficial owner of that domain and PW Hosting LLC acts as your registration service provider. Domains are held in PW Hosting LLC’s registrar account (currently Amazon Registrar / Amazon Route 53 Domains, or another registrar PW Hosting LLC may use). PW Hosting LLC will appear as the registrant of record, registered name holder, or equivalent organization contact for operational, verification, and registrar requirements. That listing does not make PW Hosting LLC the beneficial owner of the domain, a trustee, a fiduciary, or a guarantor of continued registration. You remain responsible for the domain’s use, content, payment, renewal, and any disputes about it.
You manage registration settings through the PW Hosting control panel or by contacting support@pwhosts.com. You may request a transfer away subject to registrar lock periods, unpaid domain fees, chargebacks, abuse holds, court orders, registry rules, and applicable ICANN or registry policies. PW Hosting LLC may decline, delay, or condition a transfer when fees are unpaid, the account is in dispute, the domain is locked, a legal or abuse process is pending, or transfer would expose PW Hosting LLC to legal or operational risk.
You are solely responsible for tracking expiration dates, enabling or disabling auto-renew, keeping a valid payment method on file, and renewing before the domain expires. PW Hosting LLC may send renewal reminders as a courtesy. Reminders are not guaranteed, may fail to arrive, and do not shift responsibility to PW Hosting LLC. Auto-renew, if enabled, is an attempt to charge your payment method and renew with the registrar; it may fail because of card issues, account standing, registrar or registry rejection, system error, or other reasons. PW Hosting LLC is not obligated to renew a domain, pay a renewal from its own funds, redeem an expired domain, or notify you beyond any reminder it chooses to send.
If a domain is not renewed on time, your rights in that registration end at expiration to the fullest extent permitted by the registrar and registry. The domain may stop resolving, enter grace or redemption periods, be parked, deleted, auctioned, or registered by a third party. PW Hosting LLC may change nameservers or contact records after expiration as required by the registrar. Restoration, if available at all, may require extra fees and is not guaranteed. You assume all risk of expiration, non-renewal, failed auto-renew, failed transfer, registrar or registry action, and permanent loss of a domain name.
PW Hosting LLC’s role as registrant of record does not create any duty to monitor your domain, pay expired fees, defend trademark or UDRP claims, answer third-party legal process on your behalf, or keep the domain registered after non-payment, cancellation, or termination. If PW Hosting LLC receives a legal, registrar, registry, or abuse notice because it is listed as registrant, it may forward the notice, disclose your account information, suspend or lock the domain, or take other action it reasonably believes is required. You must cooperate and you remain responsible for the underlying claim.
You are responsible for keeping admin, technical, and billing contact details accurate. Domain expiration, DNS propagation, blacklist status, third-party outages, registry or registrar issues, verification requirements, privacy-protection limits, and external provider policies may affect service and are not fully controlled by PW Hosting LLC. PW Hosting LLC is not liable for actions, errors, outages, policy changes, or suspensions by Amazon, any registrar, any registry, ICANN, or any other third party.
For domains you register elsewhere, you remain responsible for domain registration, renewal, DNS settings, nameserver configuration, registrar account security, email clients, and third-party services unless PW Hosting LLC expressly agrees to manage them.
Email transmission and receipt are not guaranteed. Spam filters, recipient servers, authentication records, blocklists, rate limits, message content, user complaints, and third-party rules can affect deliverability.
13. Intellectual Property
The PW Hosting LLC name, website design, graphics, text, layout, service descriptions, branding, and related materials are owned by PW Hosting LLC or its licensors and may not be copied, modified, or used except as allowed by law or written permission. You may not use PW Hosting LLC branding in a way that implies endorsement, partnership, or sponsorship without written approval.
14. DMCA, Abuse, and Legal Requests
Copyright, abuse, phishing, malware, spam, security, law-enforcement, and legal requests should be sent to support@pwhosts.com. Reports should include the affected domain or URL, evidence, timestamps, contact information, and any statements required by applicable law. PW Hosting LLC may remove content, disable access, suspend service, preserve records, disclose information, or take other action when appropriate or legally required.
15. Suspension and Termination
PW Hosting LLC may suspend, restrict, or terminate service with or without prior notice for non-payment, chargebacks, security risk, abuse complaints, legal risk, policy violations, inaccurate account information, resource abuse, network harm, or conduct that PW Hosting LLC reasonably believes may expose PW Hosting LLC, customers, users, or third parties to harm or liability.
PW Hosting LLC may, at any time and in its sole discretion, refuse, decline, or discontinue service to any person, account, domain, or customer, with or without notice and with or without stating a reason, to the fullest extent permitted by law.
Without limiting the foregoing, migration eligibility is not guaranteed, and PW Hosting LLC may decline to migrate any customer or account from ProHosting to PW Hosting, decline continued support after migration, or terminate/decline service where migration or ongoing support is technically impractical, excessively complex, or creates unacceptable operational, security, legal, or business risk, in its sole discretion.
After termination, PW Hosting LLC may delete or retain data according to operational, legal, backup, security, or billing needs. You should retrieve data before cancellation or termination whenever possible.
16. Disclaimers
The website and services are provided “as is” and “as available.” To the fullest extent permitted by law, PW Hosting LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, security, availability, deliverability, compatibility, data integrity, domain registration, domain renewal, domain transfer, and continued registration or control of any domain name. PW Hosting LLC does not warrant that service will be uninterrupted or error-free, that a domain will be registered, renewed, transferred, or remain registered, or that you will not lose a domain name for any reason.
17. Limitation of Liability
To the fullest extent permitted by law, PW Hosting LLC will not be liable for any suspension or loss of services, including domain name registration services; interruption of services or of your business; access delays or interruptions; downtime; lost profits; lost revenue; lost business; lost goodwill; lost data; security incidents; cost of substitute services; expired, suspended, deleted, transferred, or lost domain names; failed renewals or auto-renewals; failed transfers; registrar or registry actions; application of any dispute policy; or any loss arising from PW Hosting LLC being listed as registrant of record. PW Hosting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, even if advised of the possibility of such damages.
Those exclusions come first. If a claim still proceeds, PW Hosting LLC’s total liability will not exceed the amount you paid to PW Hosting LLC for the specific affected service or, for a domain-name claim, the registration or renewal fee you paid to PW Hosting LLC for that domain name, unless applicable law requires a different limit.
18. Indemnification
You agree to defend, indemnify, and hold harmless PW Hosting LLC and its owners, employees, contractors, providers, vendors, registrars, registries, and agents from claims, damages, liabilities, costs, and expenses arising from your content, account activity, domain names, domain use, domain disputes, UDRP or similar proceedings, trademark or other intellectual-property claims, violation of these terms, violation of law, infringement claims, privacy claims, security incidents caused by your systems or credentials, legal process directed at PW Hosting LLC because it is listed as registrant of record, or disputes with your visitors, customers, users, or third parties.
19. Governing Law and Disputes
These terms are governed by the laws applicable to PW Hosting LLC’s principal place of business, without regard to conflict-of-law rules, unless mandatory consumer law requires otherwise. Before filing a claim, you agree to contact support@pwhosts.com and give PW Hosting LLC a reasonable opportunity to resolve the issue informally.
20. Changes to Terms
PW Hosting LLC may update these terms by posting revised terms on this page. Continued use of the website or services after changes are posted means you accept the updated terms. Material changes may also be communicated by email when practical.
21. Contact
Questions about these Terms of Use should be sent to support@pwhosts.com.
